These Terms & Policies apply to your use of this website (www.divinebydesignva.com.au) and to any coaching, systems, website design or organisation services you purchase or engage from Divine by Design ("Divine by Design", "we", "us", "our"), operated in Tasmania, Australia. By using this website, submitting an enquiry, booking a discovery call or engaging our services, you agree to these terms in full. If you do not agree with any part of these terms, please do not use this website or engage our services, and contact us first to discuss your concerns.
Divine by Design is a Tasmanian owned and operated business coaching practice run by a real, practising business owner. We offer business coaching, systems and workflow design and implementation, website design and build, and business organisation services, primarily for neurodivergent business owners, and we welcome non-neurodivergent business owners too.
Our services are general business coaching, mentoring, education and hands-on implementation, built around your own goals, capacity and circumstances as you describe them to us. Nothing on this website or provided as part of our services should be read as a promise, guarantee or warranty of any particular business outcome, income, growth, or result.
Divine by Design provides business coaching, systems and organisational support. We are not a law firm, registered legal practitioner, financial adviser, registered tax agent, accountant, psychologist, counsellor or other registered health practitioner, and nothing we provide is a substitute for advice from these qualified professionals.

Where any of the above matters come up in the course of coaching, we will encourage you to seek advice from an appropriately qualified and licensed professional, and we accept no responsibility for decisions made without that independent advice.
Our role is to act as your business coach and guide: to share knowledge, ask questions, offer frameworks, build and implement systems alongside you, and support you to make your own informed decisions about your own business. You remain the owner and decision-maker of your business at all times.
We draw on our own experience, training and the information you provide us. We do our best to give practical, useful guidance, but business coaching is not an exact science, and every business and every brain is different. We cannot and do not guarantee that any strategy, system, template or piece of advice will produce a particular result for your business.
Much of our coaching is built around neurodivergent-friendly ways of working. This is a business coaching approach, not a clinical one, and it is not a diagnostic tool or a substitute for an assessment, diagnosis or treatment plan from a qualified health professional.
We may refer clients to, or partner with, The Neurodoula for deeper, more personal support around exploring and understanding neurodivergence. The Neurodoula operates as an independent practitioner in their own right. Any advice, support or services provided by The Neurodoula are their own responsibility, governed by their own terms, and are not provided by, supervised by, or the responsibility of Divine by Design.
To the maximum extent permitted by law, Divine by Design excludes all liability for any loss, damage, cost or expense (including loss of profits, revenue, opportunity, data or goodwill) arising directly or indirectly from your use of this website, your reliance on any information or advice provided, or your engagement of our coaching, systems, website or organisation services.
You engage our services and act on our guidance entirely at your own discretion and own risk. Any decisions you make about your business, including pricing, hiring, spending, contracts, marketing or systems, remain your decisions, and you are responsible for the outcomes of those decisions.
Where our services include building or implementing a website, system or workflow on your behalf, we take reasonable care in doing so, but we are not liable for third party platform outages, changes to third party software, data loss outside our control, or issues arising from your own subsequent changes to what we have built.
Nothing in these terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the relevant services or refunding the amount you paid for those services.

Pricing for coaching, systems, website and organisation services is set out on our services & pricing page or quoted to you directly, and is priced by outcome and scope rather than a flat hourly rate. Payment plans are available for some services on request.
Deposits and upfront payments secure your place in our schedule and cover the time set aside and work already underway. Once work has commenced, deposits and payments already made are generally non-refundable, except where required by the Australian Consumer Law or where we agree otherwise in writing.
If we are unable to deliver a service you have paid for, we will offer to reschedule, complete the outstanding work, or provide a partial refund reflecting the work not yet delivered, at our discretion.
Please give as much notice as possible if you need to cancel or reschedule a booked session or discovery call. Repeated late cancellations or no-shows may affect availability of future bookings or payment plan arrangements. Specific notice periods, if applicable to your service, will be set out in your individual coaching agreement or booking confirmation.
What you share with us about your business, finances, personal circumstances or neurodivergence is treated as confidential. We will not share your personal information or business details with third parties without your consent, except where required by law, where necessary to deliver a service you have requested (for example, a platform we are setting up for you), or to protect the safety of you or others.
Information submitted through our enquiry, discovery and clarity forms, or collected through this website, is used only to respond to your enquiry and deliver our services, and is not sold to third parties.
All content on this website, including our logo, branding, copy, templates, frameworks and coaching materials, is owned by Divine by Design unless otherwise stated, and is protected by copyright. Where we build or provide you with a website, system, template or document as part of our services, you receive a licence to use it within your own business, but ownership of the underlying design, template structure and any proprietary frameworks remains with Divine by Design unless we agree otherwise in writing. You may not resell, redistribute or reproduce our materials, templates or frameworks for commercial purposes without our written permission.
We take reasonable care to keep the information on this website accurate and up to date, but we make no warranty that it is complete, current or error free, and we may update or remove content at any time without notice. This website may contain links to third party websites, including social media and payment or booking platforms. We are not responsible for the content, accuracy or privacy practices of any third party website.
You may not copy, scrape, reproduce or use the content of this website for commercial purposes without our written permission.
These terms are governed by the laws of Tasmania, Australia. By using this website or engaging our services, you submit to the non-exclusive jurisdiction of the courts of Tasmania, Australia.

The version in force is the one published on this page at the time, and we will update the "last updated" date above when changes are made. If you have an existing coaching agreement in place, the terms of that agreement take precedence over any later update to this page for the duration of that agreement, unless we agree otherwise with you in writing.
